A travel booking is a separate contract
Opening an account or sending an enquiry does not reserve travel or require you to buy anything. A booking is formed only as described in the Booking Terms, after the contracting business, accepted services, full price and cancellation terms have been shown to you.
Scope and agreement
These Terms of Use & Account Agreement (the “Account Terms”) describe the conditions for the ChinaHue public website, enquiry tools and private customer account (together, the “Services”). “ChinaHue,” “we,” “us” and “our” mean the legal operator that must be identified by name and physical address in the privacy notice shown when information is collected and, for a booking, in the quote and Booking Confirmation.
You enter into these Account Terms only through an unchecked control that links to them and asks for your affirmative agreement, normally during invited-account activation. Browsing, following a link, receiving an invitation, signing in to an existing account or sending an enquiry does not by itself prove agreement to these Account Terms or create a travel booking. Public-site safety, intellectual-property and acceptable-use rules describe the permission on which site materials and tools are offered, subject to applicable law.
Our Privacy Policy explains how we handle personal information. It is a notice, not a waiver of privacy rights. If you buy travel services, the Booking Terms, your accepted quote, itinerary and journey-specific cancellation policy also apply. Those transaction documents control if they conflict with these Account Terms on a booking-specific matter.
Eligibility and authority
You must be at least 18 years old and legally able to enter into a contract to hold an account or make a booking. The website is directed to adults, even when an adult is arranging travel for children.
If you provide information or make arrangements for another traveller, you confirm that you are authorized to do so. Before you submit sensitive information for another adult, you must give that person the relevant privacy notice and obtain any authorization the law requires. A parent or legal guardian must provide information and approvals for a minor unless we approve another lawful arrangement in writing.
Invited accounts and security
Customer accounts are currently created by invitation after an enquiry or proposal; public self-registration is not offered. You must give accurate information, keep it current, protect your password and use only your own account. You may not sell, share or transfer account access.
Tell us promptly at hello@chinahue.com if you believe an account or password has been compromised. You are responsible for activity you authorize. We may require reasonable identity checks before changing account details, disclosing records or acting on sensitive requests.
You may ask us to close your account. We may retain booking, payment, safety, fraud-prevention and legal records where permitted or required, as explained in the Privacy Policy.
Consent to electronic records and signatures
When an activation or checkout screen asks you to agree electronically, you affirmatively consent to use electronic records and signatures for the account and booking documents specifically listed on that screen. Covered records include these Account Terms, quotes, booking terms, confirmations, invoices, receipts, payment and cancellation notices, itinerary updates and traveller-information requests. A notice that law requires on paper, or that is not listed at the point of consent, is not converted to electronic delivery by this sentence.
Your options
- You may save or print any linked terms before agreeing, and may request a paper copy of a record at no charge by emailing us.
- You may withdraw consent for future electronic records by emailing us with the subject “Electronic records.” Withdrawal does not affect records or signatures already provided, does not cancel an existing booking and has no fee. We will close electronic-only account access for future transactions and provide required records for an existing booking by paper mail at no charge. A future booking may require a new electronic consent unless we expressly offer a complete paper process.
- You must keep your email and mailing address current. We will actively send or deliver each record in the manner required by law; merely placing a document in an account is not delivery where applicable law requires more.
Technical requirements
You need a current web browser with JavaScript and cookies enabled, internet access, an active email address, enough storage to save records, and software capable of opening HTML and PDF files. Your device must display the agreement and allow you to save or print it. If these requirements materially change in a way that creates a significant risk that you cannot access retained records, we will provide updated requirements and obtain any renewed consent required by law.
Your electronic consent does not authorize promotional email or text messages. Marketing choices must be offered separately and remain optional.
Enquiries, proposals and availability
Public journeys are examples and starting points for private trip design. A displayed “from” price must have a genuine available basis and identify its currency, unit, occupancy or group assumption and travel-date or inventory basis. It must include every mandatory charge known for that advertised configuration; a later quote may change only because the requested configuration, dates, inventory or lawfully variable government charge differs. Sample itineraries, availability statements and preliminary proposals remain invitations to enquire unless applicable law treats a sufficiently complete proposal as an offer.
A final quote must identify the services, dates, travellers, currency, taxes and charges, payment schedule, cancellation rules, contracting entity, and any required travel-seller registration details before you are asked to pay. Do not send payment if those details are missing or inconsistent.
Information and materials you provide
You promise that information you submit is accurate to the best of your knowledge and that you have the right to provide it. You retain ownership of text, photographs and other materials you submit. You give us a limited permission to host, copy, transmit and use them only to respond, operate your account, plan or deliver requested travel, keep required records and protect the Services.
That permission does not allow us to use a traveller’s image, testimonial or story in advertising. Public promotional use requires a separate, optional release. Do not send card numbers, passport copies, health information or other sensitive documents through general enquiry text or live chat; use the secure customer workflow we designate.
Acceptable use
You may not misuse the Services. In particular, you may not:
- break a law, infringe another person’s rights, impersonate someone or submit information without authority;
- probe or bypass security, access another customer’s data, introduce malware, automate abusive requests, scrape the Services at scale or disrupt their operation;
- use site content to create a competing database, resell account access or make a false or fraudulent booking, payment dispute or cancellation claim; or
- use live chat or file uploads for unlawful, threatening or harmful content.
Reasonable use of public pages for personal trip planning is permitted.
Site content and intellectual property
The website design, brand, original copy, curated itineraries and other ChinaHue content are owned by us or licensed to us. Subject to these Account Terms, we grant you a limited, revocable, non-exclusive right to use the website and download your own transaction records for personal, non-commercial purposes.
Destination descriptions are general information, not legal, medical, immigration or safety advice. Conditions, opening hours, entry rules and supplier details can change. Verify time-sensitive requirements with the relevant authority.
Third-party services and links
The Services may link to maps, video platforms, social networks, support chat, payment providers or travel suppliers. A third party’s own terms and privacy practices apply when you use its service. A link is not an endorsement, and we are not responsible for a third-party website we do not control.
Travel suppliers are addressed separately in the Booking Terms and Booking Confirmation; this section does not reduce any responsibility we have under your booking contract or applicable consumer law.
Service availability and account action
We may maintain, update or change the website and may temporarily suspend access for security, legal or operational reasons. We may restrict or close an account that is compromised, fraudulent, unlawful or materially breaches these Account Terms. Where practical and lawful, we will give notice and a way to contact us.
Closing website access does not cancel an existing booking or remove either party’s accrued rights. We will provide a reasonable alternative channel for essential booking communications.
Website disclaimers
To the fullest extent permitted by law, the website and general destination content are provided on an “as available” basis. We do not promise uninterrupted access or that general content is complete and current at every moment. Specific written promises in an accepted booking remain enforceable.
Nothing in these Account Terms excludes a warranty, remedy or other right that cannot lawfully be excluded, including applicable consumer-protection rights.
Liability for website use
To the fullest extent permitted by law, neither party is liable under these Account Terms for indirect or consequential loss that was not reasonably foreseeable when the agreement was made. This website-use limitation does not govern liability for purchased travel services, which is addressed in the Booking Terms.
Nothing in these Account Terms limits liability for fraud, wilful misconduct, gross negligence, death or personal injury where liability cannot lawfully be limited, violation of privacy or data-security obligations, or any other non-waivable right or remedy.
Concerns, governing law and consumer rights
Please contact us first so we can try to resolve a concern promptly. A Booking Confirmation may specify the contracting entity’s governing law and forum for a particular booking. Any such provision is subject to the mandatory consumer protections and courts available where you live.
These Account Terms do not require private arbitration and do not waive participation in a class proceeding. Any later arbitration or class-action provision would need to be presented separately where lawful and would not apply retroactively.
Changes, assignment and general terms
We may update these Account Terms prospectively. The version and effective date appear at the top. If a change materially affects an active account, we will give reasonable notice and request renewed agreement where required. The version accepted for a completed transaction will remain available with that transaction.
You may not transfer an account or booking without our written approval. We may transfer these Account Terms as part of a genuine reorganization or sale only if the successor assumes our obligations and the transfer does not reduce non-waivable rights.
If a provision is unenforceable, it will be limited only as much as necessary and the rest will remain in effect. Delay in enforcing a provision is not a waiver. Headings help navigation but do not change meaning.
